WORKSHOP LIABILITY WAIVER

ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY, INCLUDING NEGLIGENCE

I agree to each and all of the following in connection with my participation in the photography workshop conducted by Martha Montiel and Shanda Akin (and their owners, employees, instructors, agents, representatives and assigns)

1) I am a healthy adult, voluntarily participating in this photography outing workshop and I assume all risks of illness, injury, death, damage, and/or loss to myself or my property that might result.

2) On behalf of myself and my personal representatives, heirs, executors, administrators, agents and assigns, I hereby release and discharge in advance Martha Montiel and her photography Workshops (and their owners, employees, instructors, agents, representatives and assigns) from any and all liability, even if that liability arises out of negligence and/or carelessness on the part of the persons or entities mentioned above.

3) My assumption of risk, waiver, and release of liability, including negligence, encompasses but is not limited to: death, bodily injury, illness, damage, theft, and/or loss of personal property during said tour/workshop which occurs as a result of anything during the entire tour/workshop. The following are some, but not all, of the possibilities:

a) traversing uneven ground, with or without photographic/video equipment in order to access off-road sites;

b) natural hazards, such as but not limited to, steep cliffs, hazardous footing, busy roadways, dimly lit building interiors and exteriors, and/or poison oak;

c) transportation to and from locations;

d) negligent instruction and/or supervision by any of the persons involved in the tour/workshop on behalf of Shanda Akin and Martha Montiel

I authorize and release to Shanda Akin and Martha Montiel the use of any of my images, or images of me, in any photograph or video recording for any purpose of future Workshops or social media marketing.

I have carefully read this Assumption of Risk, Waiver, and Release of Liability, Including Negligence. I am aware that both predictable and unpredictable risks are involved during the classes, workshops, tours, and field outings conducted on behalf of Shanda Akin and Martha Montiel. I hereby agree to assume all of those risks and to release and hold harmless all of the persons or entities mentioned above who through negligence or carelessness would otherwise be liable to me or to my heirs or assigns for damages.

CANCELLATION POLICY/LEGAL

Shanda & Martha reserve the right to cancel the workshop if the minimum 2 number of participants is not met or in the event of an emergency. In the event we do have to cancel the workshop you’ll be given a full refund.

We understand that life happens, and in the event, you need to cancel your spot in the workshop, as long as it is prior to 60 days from the first day of the workshop AND the space can be filled by another participant you will receive your full deposit back. If you need to cancel within the 60 days before the workshop, you will not receive your deposit back, but may offer a credit towards another workshop. We will always try to work with you and do whatever we can in the event you do have to cancel.

We strongly recommend you purchase insurance to protect yourself in case of travel disruptions, emergencies, or you have to cancel due to Covid-19 or any other related illnesses. We are not responsible for travel disruptions and highly recommend travel insurance for this reason!
